Marriage contract
A marriage contract is a legal instrument that regulates property relations between spouses! determines their property rights and obligations (including the rights and obligations of spouses as parents)! as well as the procedure for dividing their property.
A marriage contract cannot transfer ownership of real estate and other Agreement on property! the right to which is subject to state registration! to one of the spouses. In addition! a marriage contract cannot regulate the personal relations of the spouses (personal relations between them and children)! put one of the spouses in an extremely disadvantageous financial situation! and cannot reduce the scope of the child’s rights established by the Family Code of Ukraine.
Any marriage contract is concluded in writing and is subject to notarization.
This agreement regulates exclusively the procedure for loan data dividing the spouses’ joint property and Agreement on determining the shares in their joint property. It is important that the division of property based on this agreement applies only to joint joint property! that is! property that was acquired during family life and was owned by both people on the basis of the principle of equal shares (again! unless otherwise provided for by agreement or contract).
Such an agreement is concluded in writing and is subject to notarization only if the subject of the division is real estate (in particular! an agreement on the division of a residential building! apartment! etc.! or on the allocation of real estate to the wife or husband from among all the marital property).
Who can conclude?
A marriage contract may be concluded only by spouses or persons who have filed an application for marriage registration.
An agreement on the division of marital property may they should be able to use be concluded by spouses! persons living in the same family but not married to each other! and divorced persons.
When can I sign a contract?
A marriage contract cannot be concluded after the atb directory divorce of the spouses. In addition! the latter enters into force after the registration of the marriage! if it was concluded by the persons who submitted an application for registration of the marriage.
An agreement on the division of marital property can be concluded both during marriage and after its dissolution.
